(hereinafter referred to as "Agroecopower" or "Seller")
1. Purpose
AgroEcoPower LLC, with its registered office at 321 East 73rd Street, New York, NY 10021, (hereinafter referred to as the "Administrator"), grant within the related US federal and state Data Protection Regulations (based on FTC Act; 15 U.S. Code § 41 et seq. / f. e. VPPA; 18 U.S. Code § 2710 et seq.) as well as the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27th 2016 on the protection of individuals with regard to the processing of personal information and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), to process personal information in that respect.
2. Scope of processing
When purchasing goods or services offered by Agroecopower LLC, customers may be asked to provide personal data: name, surname, e-mail address and telephone number. This data and content serve as a means to carry out the transaction between the customer and the company Agroecopower LLC.
If the contract requests a specific vehicle type, data on the make, vehicle model and the region are also processed. The indication of the region is optional and serves to recommend the most suitable partner to the customer. The Administrator expressly states that it does not collect or process any personal data that customers do not provide voluntarily.
3. Purpose of processing
The purpose for which such data will be processed, if any, arises from the needs necessary for the conclusion and completion of the contract, in example the sale of goods and services. In general, the personal data will be processed by the Administrator for the purpose of selling services and products offered on the agroecopower.com website.
All personal data provided by the customer (hereinafter asl as the “data subject”) to the Administrator will be stored in accordance with the relevant legislation and adequately protected against misuse throughout the processing.
4. Processing time
The period of processing personal data is for the duration of the legal obligation to keep accounting documents.
5. Automated decision making, including profiling
The Administrator may collect and analyze information related to the use of the agroecopower.com website by customers. This information can be obtained through "cookies", small text folders placed by the server on the customer's hard drive. The customer is entitled to select (dis) enabling "cookies" within the settings of his search engine.
Customers' personal data are processed automatically and manually and may be made available to the Administrator's staff, processors with whom the Administrator has a contract for the processing of personal data, or other persons authorized under the rules set out. The Administrator does not perform user profiling.
6. Legal basis of processing
Customers‘ personal data are processed on the basis of the needs necessary for the conclusion and completion of the contract, in example the sale of goods and services. Consent to the processing of personal data is not required for this processing.
7. Transfer to 3rd parties
The Administrator does not transfer the personal data of customers to third parties for processing outside:
• External accounting office with which the Administrator has a Personal Data Protection Agreement
• Affiliated companies (according to the rules of particular law), in example companies that the company, Agroecopower LLC jointly / owns or jointly / controls or is controlled by these companies Agroecopower LLC jointly / owned or jointly / controlled.
8. Transfer to 3rd countries
The Administrator does not transfer personal data of customers to 3rd countries.
9. Customer statement
The customer acknowledges that he is obliged to state his personal data (when ordering from Agroecopower LLC) correctly and truthfully and that he is obliged to inform the Administrator without undue delay of a change in his personal data.
10. User Rights
If the customer requests information on the processing of his personal data from Agroecopower LLC, the Administrator is obliged in accordance with the particular law principle to transmit this information to him without undue delay and to comply with all relevant legislation and law provisions. Any customer who discovers or suspects that the Administrator or a specific processor of personal data carries out the processing of his personal data which is contrary to the protection of the privacy and personal life of the customer or contrary to the legislation, in particular if: personal data inaccurate with regard to the purpose of their processing, may request an explanation from the Administrator or the specific processor and request that the Administrator or processor rectify the situation thus created. In particular, it may be a matter of blocking, correcting, supplementing or disposing of personal data.
The customer has:
• the right of access to personal information, incl. on how they are processed, • the right to restrict, rectify, supplement or delete my personal information, • the right to the portability of my personal information,
• right to object to the processing of depreciation
